RUTLAND TOWN BOARD MEETING
OCTOBER 15, 2008 6:30 P.M.
Chairman Dale Beske called the meeting to order. Other Board members present were Supervisors Shapiro Hurley, Lunde and Sperle, Clerk George, and Treasurer Sime. A number of residents and other interested parties were present. A sign up sheet is on file.
1. Discussion of and possible amendment to current Firearm Ordinance (adopted in 1959) to include more current terminology. Chairman Beske read the 1959 ordinance to those present. The draft revision was reviewed. Supervisor Sperle felt that draft revisions stated the Boards intent more clearly. Chair Beske felt that the intent of the Board in modifying the ordinance was to make it clear to everyone that it still applies. Town resident Bill Kortte disagreed with the Boards intent to address safety concerns. He felt the Board should repeal the 1959 ordinance. He further stated that he is tired of being regulated by the minority (irresponsible hunters) and that the responsible hunter was being punished for the actions of the irresponsible. Shapiro Hurley advised that there was a great deal of data collected by the DNR relative to the safety issue. On the matter of enforcement, Shapiro Hurley advised that the WDNR would not enforce local ordinances because they cant they dont have the authority. She further advised that if the wardens saw someone hunting with a rifle, they would advise them of the existence of the local ordinance. Kortte felt the town couldnt make laws more restrictive than the DNR. It was pointed out that the town could make rules more restrictive under certain circumstances and that the town could not govern hunting. The existing ordinance has been in effect for over 40 years and the safety concerns of hunting with a rifle in densely populated areas have not changed. Actually, the density is greater now than it was when the original ordinance was adopted. Resident Jerry Booth spoke about the fact that he could not believe that the DNR opened the area up to rifle hunting. He felt that a shotgun slug would not reach his house which is near a public hunting ground, where a rifle bullet could. Shapiro Hurley stepped down on this matter as a Board member and addressed it as an employee of the DNR. Beske advised those present that when the board addressed the matter at the previous meeting, Shapiro Hurley had abstained from voting on the matter. Shapiro Hurley advised that the DNR wanted to simplify the deer hunt by removing the zones etc. The goal of the DNR was to reduce the deer herd and the advisory group recommended allowing rifles in southern Wisconsin to encourage more people to get involved. Booth felt that most hunters were surprised that rifles were being allowed everywhere. Siting of rifles would be allowed as long as it is not done the day before or during a gun deer hunting season.
Discussion on the modification of the ordinance continued. The board determined that the reference in the draft ordinance modification to hunting should be deleted and that language should be added to the ordinance specifying that the ordinance would prohibit discharging a rifle that is legal for deer hunting. Sperle moved, Lunde
seconded, to adopt the following ordinance with the modifications noted above; motion carried 3-0 with one abstention (Shapiro Hurley). Note: Later in the meeting
the board decided to see if we could obtain enlarged copies of the ad placed in the newspapers for posting at the various public hunting grounds in the town.
ORDINANCE 2008-10-01
AN ORDINANCE AMENDING THE TOWN OF RUTLAND FIREARMS REGULATIONS.
WHEREAS, the Town Board previously enacted an ordinance prohibiting the discharge of rifles during the gun deer hunting season; and
WHEREAS, the current ordinance has not been updated since 1959; and
WHEREAS, the Town Board has determined that it is in the public interest that the ordinance be updated and revised; and
WHEREAS, the Town Board is authorized to enact ordinances in order to protect the public health, safety and welfare by §§60.22(1), 60.22(3), 61.32 and 61.34 of the Wisconsin Statutes; and
WHEREAS, the Town Board has determined that it is reasonable and necessary to prohibit the use of rifles within the Town during any gun deer hunting season in order to protect the public safety;
NOW, THEREFORE, the Town Board of Rutland, Wisconsin, does ordain as follows:
Section 1. It shall be unlawful for any person to discharge a rifle that is legal for deer hunting within the Town of Rutland during any time the hunting of deer with a firearm is permitted by applicable law or administrative regulations.
Section 2. Any person who shall violate this ordinance shall, upon conviction thereof, be subject to a forfeiture of not less than $100 nor more than ($500.00). Each day that a violation is committed shall constitute a separate violation.
Section 3. This ordinance shall be effective on the day after its enactment and publication of this ordinance or an appropriate notice thereof as provided by law.

2. Discussion of and possible adoption of NSF Check Policy. Motion /second by Shapiro Hurley and Sperle to adopt the NSF Check Policy as presented; motion carried 4-0. The NSF Check Policy is as follows:
TOWN OF RUTLAND NSF POLICY
It is the policy of the Town of Rutland to add a charge to any payment checks that come back marked Not Sufficient Funds (NSF) plus any fee that is charged by the Towns bank.
The amount of the charge shall be set by the Town Board from time to time and shall be listed on the Fee Schedule. The amount of any bank fee shall be the actual amount charged to a town bank account specifically stated as being a charge for a returned check.
3. Discussion of and possible amendment of the Fee Schedule (Addendum to Ordinance 06-12-01) to update dog license fees and to add NSF fees. The Town has been advised that Dane County will be increasing the fees collected from the municipalities for each dog license issued by $2.50 per dog. Motion/second by Sperle and Shapiro Hurley to adopt a revised fee schedule to change the fees charged for dog licenses as follows: The fee for spayed or neutered dogs will change from $10.00 to $15.00; the fee for unsprayed or unneutered dogs will change from $15.00 to $20.00; the fee for kennel will change from $78.00 to $100.00; the fee for a NSF check will be $30.00; motion carried 4-0. A complete copy of the revised fee schedule is attached at the end of the minutes.
It was clarified that the Dog Control Ordinance 2007-01-01 has a specific clause that states no kennel license will be issued to any person without a conditional use permit for a kennel.
4. Discussion and possible action of Town contribution to survey fees for elevation determinations between Village of Brooklyn and Hwy 14/92/Biglow Rd. intersection. Beske reported that he had not received any figures on the cost of the elevation survey work. He further reported that he had attended a meeting earlier in the day with Ken Bradbury, hydrogeologist with UW Extension, Brooklyn Village President Nadine and Tryg Knutson regarding the matter and there may be temporary monitoring wells installed and monitoring along Hwy 92 that will help determine water table behavior in our area. This would be free. There may also be a study conducted by a civil engineer which is estimated to cost about $30,000. Some of the funding for such a study could possibly be obtained from outside sources including the Fish and Wildlife.
5. The Board reviewed the proposed 2009 Budget line by line. The Budget Summary will be completed and published and posted for action at the November 5th Budget Hearing, Town Meeting and Board Meeting.
6. The meeting was adjourned on motion and second by Sperle and Lunde; motion carried 4-0.
